By accessing or using BYOAPI Chat ("the Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Thomas Oeser trading as Furious Gryphon Studio, ABN 14 928 364 119, located in Sydney, New South Wales, Australia ("we," "us," or "our").

If you do not agree to these Terms, you may not access or use the Service.

BYOAPI Chat is a web-based AI chat application that allows users to:

• Connect their own API keys from AI providers (Anthropic, OpenAI, Perplexity)
• Chat with various AI models using their own API credits
• Manage conversations and AI personas
• Switch between different AI models mid-conversation

3. Account Registration and Security

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 18 years old to use the Service

3.2 API Key Management

• You must comply with all terms and conditions of your API providers
• We encrypt your API keys using your master key but cannot recover them if you lose your master key
• You are responsible for all usage and costs associated with your API keys

• Generate harmful, abusive, or illegal content
• Attempt to gain unauthorized access to our systems
• Reverse engineer or attempt to extract our source code
• Abuse our infrastructure through excessive automated requests or attempts to circumvent usage limitations
• Share your account credentials with others
• Violate the terms of service of any AI provider whose APIs you connect to the Service
• Use the Service in a manner that could damage, disable, or impair our servers or networks

5. Payment Terms

5.1 One-Time Payment

• Payment processing is handled by secure third-party payment processors
• All sales are final - no refunds after 30 days from purchase

5.2 API Costs

• You are solely responsible for all costs incurred through your API usage
• We do not mark up or add fees to your API usage costs
• Usage costs are billed directly by your chosen AI providers

6. Intellectual Property

6.1 Our Rights

• The Service, including its design, functionality, and code, is owned by Furious Gryphon Studio
• Our trademarks and logos may not be used without written permission

6.2 Your Content

• You retain ownership of content you create using the Service
• You grant us a limited license to process your content to provide the Service
• You are responsible for ensuring you have rights to any content you input

7. Privacy and Data Protection

8. Third-Party Services

8.1 AI Providers

• The Service integrates with third-party AI providers (Anthropic, OpenAI, Perplexity)
• You must comply with each provider's terms of service
• We are not responsible for the availability, accuracy, or content of third-party services

• We use Supabase for data storage and authentication
• Third-party service outages may affect Service availability

9. Service Availability

9.1 Uptime

• We strive to maintain high availability but cannot guarantee 100% uptime
• Scheduled maintenance will be announced when possible
• We are not liable for service interruptions

9.2 Free Trial

• Free trial usage is subject to fair use limitations
• Trial access may be revoked for abuse

• Your use of the Service
• Your violation of these Terms
• Your violation of third-party rights
• Content you create or share through the Service

12. Termination

• You may stop using the Service at any time
• Account deletion does not entitle you to a refund

• We may suspend or terminate accounts for Terms violations
• We may discontinue the Service with 30 days' notice
• Upon termination, your right to use the Service ceases immediately
